Charrington Tree Services – Terms & Conditions

By accepting a quotation provided by Charrington Tree Services, either in writing or by

allowing work to commence, the Customer is deemed to have accepted these Terms &

Conditions in full.

 

1. Customer Responsibilities

1.1 Ensure safe and unobstructed access to the work site for personnel, machinery, and vehicles always.

1.2 Children must be supervised and kept at a safe distance from any work. Safe distances will be set out by the Team Leader on-site; the company accepts no liability for injury resulting from a failure to follow these safety boundaries.

1.3 Pets must be kept away from staff and the work area for the duration of the project. All animal waste must be cleared from the work area prior to our arrival to ensure a safe and hygienic working environment.

1.4 Provide adequate parking for vehicles and trailers. The customer is responsible for any parking costs. Any fines incurred due to inadequate parking arrangements will be the responsibility of the customer.

1.5 Ensure that all permissions, consents, and planning approvals have been granted for the work requested, including permissions from neighbours or third parties where applicable.

1.6 Inform Charrington Tree Services of the location of any underground or overhead utilities (including cables, pipes, drains, or other services) prior to the commencement of works. Ideally, a plan should be provided. We accept no liability for damage to any such services not clearly disclosed or identifiable in advance.

1.7 Obtain any necessary permissions for access across neighbouring land. Charrington Tree Services accepts no liability for claims or disputes arising from a lack of neighbour consent.

1.8 Accurately identify the property boundary and the ownership of the trees to be worked upon. Charrington Tree Services accepts no liability for work carried out on trees incorrectly identified by the customer.

 

1.9 Ensure the designated "drop zone" and work area is cleared of all movable garden furniture, ornaments, plant pots, and washing lines prior to our arrival. While every care is taken, the company accepts no liability for damage to items left within the work area.

1.10 Allow the use of a water supply and, where work exceeds a single day, access to toilet facilities for staff where reasonably practicable.

Respect and Conduct: Charrington Tree Services operates a zero-tolerance policy towards any abusive, threatening, or inappropriate behaviour directed at our staff. In such cases, the company reserves the right to stop work immediately and terminate the contract. In the event of such termination, the customer will be liable for the full cost of all works completed up to that point, plus any disposal or mobilisation costs incurred by the company.

 

2. Charrington Tree Services Responsibilities

2.1 Conduct a thorough on-site risk assessment prior to commencing work.

2.2 Provide appropriate safety signage, barriers, and banksmen where required to protect the public and staff.

2.3 Supply all equipment, qualified personnel, and insurance (£5m Public / £10m Employers) necessary to complete the work safely.

2.4 Carry out all works in accordance with BS 3998 (Recommendations for Tree Work).

2.5 Waste removal will be carried out as per the specific agreement in the quotation.

2.6 Leave the site clean and tidy. While we clear to the best of our ability, the customer acknowledges that minor debris (sawdust, small twigs, or leaf litter) is an inherent byproduct and may remain.

2.7 Wildlife & Ecology: We reserve the right to delay works to comply with the Wildlife and Countryside Act 1981 if nesting birds or bats are found.

2.8 Stumps: Unless otherwise agreed in writing, stump grinding is excluded. Stumps will be left as close to ground level as is safely practicable with a chainsaw.

2.9 Weather: We reserve the right to reschedule work if weather conditions make the site or operation unsafe.

Insurance: Charrington Tree Services holds full public liability (£5m) and employer’s liability insurance (£10m). Copies of certificates are available upon request.

 

3. Additional Works & Variations

3.1 Any extra works (e.g. stump grinding, additional pruning) will be agreed upon with the customer before being undertaken, including task details and associated costs.

3.2 Should unforeseen conditions arise—such as hidden obstructions (including metal or stone embedded in timber), advanced decay, access restrictions, or safety risks not apparent during the initial inspection—Charrington Tree Services reserves the right to revise the quotation or reassess the scope of work. All changes will be agreed upon with the customer before proceeding.

3.3 Environmental & Wildlife Considerations: Charrington Tree Services complies with all relevant wildlife and environmental legislation, including the Wildlife and Countryside Act 1981 and the European Habitats Directive.

3.4 If protected species (e.g. nesting birds or bats) are discovered during works, operations will be suspended or modified immediately until it is safe and lawful to continue. The company accepts no liability for delays caused by statutory wildlife protection.

 

4. Force Majeure / Events Beyond Our Control

4.1 Charrington Tree Services shall not be liable for any delay, loss, or failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to adverse weather (high winds, lightning, or torrential rain), accidents, illness, strikes, fire, flooding, government restrictions, or major mechanical failure of specialist equipment.

4.2 In such cases, the work will be rescheduled at the earliest safe opportunity. The company accepts no liability for any indirect or consequential losses (e.g., loss of earnings or childcare costs) incurred by the customer as a result of the delay.

 

5. Liability & Indemnity

5.1 Charrington Tree Services will exercise all reasonable skill and care in carrying out the agreed works in accordance with industry standards.

5.2 We accept no responsibility for damage to property or services (underground or overhead) not disclosed in advance by the customer as required in Section 1.

5.3 Except in cases of proven negligence resulting in personal injury or death, our total liability shall be limited to the value of the contracted works.

5.4 The customer agrees to indemnify and hold harmless Charrington Tree Services against any claims, losses, or damages arising from their failure to comply with these terms, including providing inaccurate information, lack of legal ownership of the trees, or failure to obtain necessary third-party permissions.

5.5 Indirect Damage: While every effort is made to prevent ground disturbance, the company accepts no liability for minor damage to lawns, paths, or driveways that is unavoidable in the course of performing the work, unless such damage is caused by gross negligence.

 

6. Payment, Cancellation & Complaints

6.1 Quotations: All quotes are valid for 30 days. We reserve the right to amend the price after this period due to changes in site conditions or costs.

6.2 Payment Terms: Invoices are due for payment immediately upon completion of the works unless otherwise agreed in writing. For projects exceeding £2,000, we reserve the right to request a 25% deposit prior to booking.

6.3 Late Payment: Charrington Tree Services reserves the right to charge interest on any overdue accounts at a rate of 8% above the Bank of England base rate, calculated daily from the due date until payment is received.

6.4 Cancellation Policy & Right to Cancel (Cooling off period):

 Statutory Right to Cancel: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, domestic customers have the right to cancel this contract within 14 days of acceptance without giving any reason.

  • Emergency/Urgent Work: If you request that work commence before the 14-day cooling off period has expired, you acknowledge that you will be liable for the cost of any work performed up to the point of cancellation. If the service is fully performed within this period at your request, the right to cancel is lost.

Outside of the 14 day cooling off period.

  • More than 72 hours' notice: No charge.

  • Less than 72 hours' notice: A cancellation fee of 25% of the total quote will be charged to cover lost labour and administrative costs.

  • On-the-day Cancellation: If we arrive on-site and are unable to work due to the customer’s failure to meet their responsibilities (as per Section 1), the full daily rate or quoted amount may be charged.

 

6.5 Complaints: Any concerns or complaints regarding the quality of work must be raised with the Team Leader on-site or sent in writing to our office within 7 days of completion. We aim to resolve all legitimate issues within 14 days.

 

7. Data Protection (GDPR) & Privacy Policy

7.1 Charrington Tree Services is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

7.2 We collect and process your personal information (name, address, contact details) solely for the purposes of providing quotations, performing contracted works, and invoicing.

7.3 Your data will not be shared with third parties for marketing purposes. It may be shared with subcontractors or regulatory bodies (e.g., Local Planning Authorities for TPO applications) only where necessary to fulfil our contractual or legal obligations.

7.4 You have the right to access, rectify, or request the erasure of your personal data at any time.

7.5 Photographs and Media: The company reserves the right to take photographs or video of the work site and trees for the purposes of project planning, insurance records, and internal training.

7.6 Marketing Consent: We may occasionally use photographs of completed works for marketing purposes (e.g., website or social media). We will ensure that no personal data (such as house numbers, vehicle registrations, or individuals) is identifiable in these images. If you do not wish for images of your property to be used for marketing, please notify us in writing.

 

Acceptance of Terms: By accepting a quotation provided by Charrington Tree Services, either in writing or by allowing work to commence, the Customer is deemed to have accepted these Terms & Conditions in full.
